Am I eligible for gratuity in the UAE?

In the UAE, only expats are entitled to gratuity pay. Emirati citizens don’t receive it because they are already enrolled in the national pension program, which isn’t available to expatriates.

Can my gratuity be denied?

Gratuity isn’t guaranteed for everyone leaving a job in the UAE. As per Article 139 of the Labour Law, employees can lose this benefit in certain cases:

  • Resigning without giving the required notice period, unless there’s a legitimate reason. This applies to both limited and unlimited contracts if employment is under five years.
  • Being dismissed for specific legal grounds, or resigning to escape dismissal, can also mean forfeiting gratuity.

Formula for Calculating Gratuity on a Limited Contract

A limited contract binds an employee to a specific term of employment. Exiting before completion of this period may lead to forfeiture of gratuity and related benefits. The gratuity entitlement under such contracts is calculated as:

  • For 1–5 years of continuous service:
    (Basic Salary × 21 days × years of service) ÷ 30
  • For service exceeding 5 years:
    (Basic Salary × 30 days × years of service) ÷ 30

Formula for Calculating Gratuity on Unlimited Contracts

With an unlimited contract, there’s no set end date. You can leave your job by giving one to three months’ notice, and no matter if you resign or are terminated, you’ll still receive your gratuity.
